By using Adcdata.com Services, you agree to be bound by this Agreement.

General Agreements

a. By using the Services, you also agree to the terms of the following policies
i. Privacy Policy - under Hong Kong SAR law
ii. Copyright Infringement Policy - under Hong Kong SAR law

b. You are eighteen (18) years of age or older. And you have to be responsible for your actions, behaviors, languages, on the network/internet.

c. You held responsibility of providing correct and up-to-date contact information to us

d. You held responsibility to maintain the confidentiality of your password and other information related to the security of your account

Data & Content

1. You are solely responsible for any data or content or other activities conducted on or through your assigned VPS/Servers/Website/Account. By posting or distributing User Content on or through the Services, it is your responsibility to make sure such actions do not infringe or violate the rights of any third party, or the Hong Kong copyright law.

Adcdata exercises no control over, and accepts no responsibility for, Data & Content passing through Adcdata's servers and network hubs. Adcdata does not monitor content-level user activities. However, you acknowledge and agree that Adcdata may take any corrective action in Adcdata's sole discretion, including removal of your data or content, and/or suspend/terminate your service/account without refund.

2. You are solely responsible for backing-up all Data & Content in your assigned servers/VPS/website/accounts. Adcdata provides backup service to VPS product line as courtesy and does not hold any responsibility of keeping/losing any data within, and does not guarantee any successful return of backup data, and you hereby accept the risk of loss of data/content, if any, by using our services.

3. You are solely responsible for all security related settings/deployment of your server/VPS/website/Accounts. Adcdata held no responsibility of any corruption, loss, leak, steal, impeachment or destroy of the data/content within your server/VPS/website/accounts, rather by virus, hackers, 3^rd parties, or any others. And Adcdata does not have any responsibility of providing any measures of protecting the data/content.

Hacker Activities
Adcdata may suspend/terminate your service without refund if your server/VPS/website/account is under attacks by any kinds of hacker activities, such as DDoS, virus, spams, or any other form.

Child Pornography
Adcdata immediately terminate your service and report to police.

Bandwidth Usage
Adcdata reserves the right to implement speed cap, terminate, or suspend your service upon the following conditions:

a. Abuse use of network bandwidth

b. Illegal activities are detected from your service

c. International traffic (outside HK) consistently exceeds 1Gbps for 24 hours
*without extra purchase of dedicated bandwidth

d. Direct China route traffic exceeds 20Mbps for an hour
*without extra purchase of dedicated bandwidth

e. Affect other servers in the network

f. Spam emails

g. Send any packets with spoof ip address

h. Brute-force attacks on other servers

i. Under DDoS or DoS attacks others

j. BT (torrent) any copyright content

k. Use as distribution point of any copy-right content, esp movie, mp3 etc

Billing and Payment

1. Auto-renewal
You agree that you are automatically billed by your paypal or credit card once you made recurring payments in our client area. You may, however, ask for refund if any of the transactions you consider as unauthorized or defy your will.

2. Domain Registration Fee
You agree that refund is not possible for domain name registration payment.

3. Disputes
You have 30-day to register any mistake or wrong doings of any invoices, transactions, or billing/renewals.

4. Dedicated Servers
Adcdata offers a 30-day money- back guarantee

5. Web hosting/VPN services
Adcdata offers a 30-day money- back guarantee

6. VPS services
You have 7 days to file refund request

7. Cancellation
You agree to give us at least 7-day prior notice for any cancellation of service request

8. Currency
All refunds are processed in HKD, and you accept all the currency fluctuation during the period

Disclosure to Law Enforcement
Adcdata may disclose User information to law enforcement agencies without further consent or notification to the User upon lawful request from such agencies. We cooperate fully with law enforcement agencies.

Agreement changes/modifications
Adcdata have the right to change or modify this agreement at any time. And after each changes/modifications, you agree to obey/agree renewed agreement by using our services.
